SC Shark Participant Waivers

Please read waivers carefully.  They include releases of liability and waiver of legal rights and deprive you of the ability to sue certain parties.  Do not agree to these documents unless you have read and understood it in its entirety. By agreeing electronically, you acknowledge that you have both read and understood all text presented to you as part of the registration process. You also understand and agree that events carry certain inherent dangers and risks which may or may not be readily foreseeable, including without limitation personal injury, property damage or death. Your ability to participate in the event(s) is/are subject to your agreement to the waivers and by agreeing herein, you accept and agree to the terms of the waiver and release agreements.

Registration Waiver

By indicating your acceptance, you understand, agree, warrant and covenant as follows:

SC SHARK LACROSSE REGISTRATION AGREEMENT AND LIABILITY WAIVER (the "Agreement and Waiver")

1. Authority to Register and/or to Act as Agent. You represent and warrant to SC Sharks lacrosse ("SCS") that you have full legal authority to complete this event registration on behalf of yourself and/or any party you are registering (the "Registered Parties"), including full authority to make use of the credit or debit card to which registration fees will be charged.  As used in this Agreement and Waiver, SCS refers to SCS Lacrosse and any and all subsidiaries, affiliated entities, or entities that control or are controlled by SCS singly or together and its officers, employees, contractors, subcontractors and agents. 

If you are registering a child under the age of 18 or an incapacitated adult you represent and warrant that you are the parent or legal guardian of that party and have the legal authority to enter into this agreement on their behalf and by proceeding with this event registration, you agree that the terms of this Agreement and Waiver shall apply equally to all Registered Parties. By registering a child under 13, you agree and consent to the collection of that child's information which you provide for the purposes of registration.

2.  Waiver. YOU UNDERSTAND THAT PARTICIPATION IN THE EVENT IS POTENTIALLY HAZARDOUS, AND THAT A REGISTERED PARTY SHOULD NOT PARTICIPATE UNLESS THEY ARE MEDICALLY ABLE AND PROPERLY TRAINED.  YOU UNDERSTAND THAT EVENTS MAY BE HELD OVER PUBLIC ROADS AND FACILITES OPEN TO THE PUBLIC DURING THE EVENT AND UPON WHICH HAZARDS ARE TO BE EXPECTED.  PARTICIPATION CARRIES WITH IT CERTAIN INHERENT RISKS THAT CANNOT BE ELIMINATED COMPLETELY RANGING FROM MINOR INJURIES TO CATASTROPHIC INJURIES INCLUDING DEATH.   YOU UNDERSTAND AND AGREE THAT IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE EVENT, YOU AND ANY REGISTERED PARTY, THE HEIRS, PERSONAL REPRESENTATIVES OR ASSIGNS OF YOU OR THE REGISTERED PARTY DO HEREBY RELEASE, WAIVE, DISCHARGE AND CONVENANT NOT TO SUE WHL FOR ANY AND ALL LIABILITY FROM ANY AND ALL CLAIMS ARISING FROM PARTICIPATION IN THE EVENT BY YOU OR ANY REGISTERED PARTY.  

3. Limitation of Liability; Disclaimer of Warranties. SCS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM (A) THE USE OR THE INABILITY TO USE WHL OR (B) FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR (C) RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH WHL OR (D) RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF WHL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY AGREE THAT USE OF WHL IS AT YOUR SOLE RISK. WHL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WHL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

SCS makes no warranty that the SCS sites' services will be uninterrupted, secure or error free. SCS does not guarantee the accuracy or completeness of any information in, or provided in connection with, the SCS sites. SCS is not responsible for any errors or omissions, or for the results obtained from the use of such information. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the SCS sites is at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of such material and/or data.

4. Indemnification. You agree to indemnify and hold each of SCS harmless from and against any and all damages, costs, claims or demands, including reasonable attorneys' fees, made by any third party due to or arising from or relating to your use of SCS or the violation of any term of this Agreement and Waiver by you.

5. Applicable Law; Consent to Jurisdiction. The SCS sites (excluding linked sites) are controlled by SCS from its offices within the State of California, United States of America. By completing this event registration, both you and SCS agree that the statutes and laws of the State of California, without regard to the conflict of laws principles thereof, will apply to all matters relating to this event registration, this Agreement and Waiver, the Terms of Use or other use of the SCS sites. You agree that exclusive jurisdiction for any dispute with SCS resides in the courts of the State of California and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of California in connection with any dispute including any claim involving SCS or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

6. Severability. You further expressly agree that this Agreement and Waiver is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any provision of this Agreement and Waiver shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and Waiver and shall not affect the validity and enforceability of any remaining provisions.

BY INDICATING YOUR ACCEPTANCE OF THIS AGREEEMENT AND WAIVER, YOU ARE AFFIRMING THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND WAIVER AND FULLY UNDERSTAND ITS TERMS.  YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE.  YOU ACKNOWLEDGE THAT YOU ARE SIGNING THE AGREEMENT AND WAIVER FREELY AND VOLUNTARILY, AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Verification of Insurance

I assure that the insurance policy is for at least $1,500.00 and will remain current and in force during the time the above named player participates in or practices for SCS Lacrosse athletic events or while being transported to and from such athletic events. I agree to indemnify and hold the SCS Lacrosse organization harmless against responsibility for insurance.

Participant Agreement / Assumption of Risk

I, the parent/guardian, do hereby understand the following:  1. SCS Lacrosse is neither a school sponsored activity nor a school sport. 2. Before, during and after practices or games, there will be no school or School District supervision. Parents are responsible for the player before the practice start time and immediately following the practice end time. 3. No transportation will be provided by the SCS Lacrosse 4. The School District, its Board of Education, SCS Board officers shall assume no responsibility or liability for SCS Lacrosse, it members, participants, officers or agents.

ASSUMPTION OF RISK

The undersigned hereby acknowledges that he/she knowingly and voluntarily assumes all risks of bodily injury to his/her child, as state, and expressly acknowledges their intention, by executing this instrument, to exempt and relieve SCS Lacrosse, Capistrano and Saddleback Unified School Districts, its Board of Education, SCS board members/ officers from any liability for personal injury, bodily injury, property damage or wrongful death that may arise out of or in any way be connected with the participation on the SCS Lacrosse Team. I have read the foregoing and have voluntarily signed this agreement. I am aware of the potential risks involved in this activity and I am fully aware of the legal consequences of signing this instrument. I further acknowledge that the Capistrano and Saddleback School Districts do not provide liability insurance for this program, nor does the Capistrano and Saddleback School Districts provide medical coverage for participants in this activity.

Authorization to Treat Minor

I (We) the undersigned parent(s)/legal guardian of a minor, do hereby authorize and consent to any x-ray examination, anesthetic, medical or surgical diagnosis rendered under the general or special supervision of any member of the medical staff and emergency room staff licensed under the provisions of the Medicine Practice Act or a Dentist licensed under the provisions of the Dental Practice Act and on the staff of any emergency general hospital holding a current license to operate a hospital from the State of California Department of Public Health. It is understood that this authorization is given in advance of any specific diagnosis, treatment or hospital care being required but is given to provide authority and power to render care which the aforementioned physician in the exercise of his best judgment may deem advisable. It is understood that effort shall be made to contact the undersigned prior to rendering treatment to the patient, but that any of the above treatment will not be withheld if the undersigned cannot be reached.


Player and Parent Code of Conduct

Prior to participation athletes must provide:

A. Participation Agreement / Assumption of Risk form signed by the parent/guardian
B. Emergency Information Form
C. Athletic Code of Conduct signed by student and parent/guardian
D. Athletic Code of Ethics signed by student and parent/guardian

Citizenship:

A. A student is considered to be an athlete from the first day of practice. SCS Lacrosse athletes must be good citizens.

B. Infractions involving the use of tobacco, other serious violations, or disciplinary action carry a mandatory penalty of suspension from team activities as follows:
- 1st Offense: Suspension from 1 to 10 days of SCS lacrosse participation
- 2nd Offense: Suspension from 10 to 15 days of SCS lacrosse participation
- 3rd Offense: Suspension from SCS Lacrosse for up to one year

C. Less serious discipline problems arising within the domain of practice and/or games are to be handled at the coaches’ discretion. The parents will be informed at the earliest possible time. If the infraction results in a player being suspended from team participation for more than one day, the coach must contact the athlete’s parents immediately.

D. Any player who verbally or through gestures communicates a profanity to an opponent, game official, or fans will be required to incur disciplinary action.

E. Any player athlete who physically assaults a game or event official shall be banned from the lacrosse team for the remainder of the player’s eligibility. A game or event official is defined as a referee, umpire or any other official assigned to interpret or enforce rules of competition at an event or contest.

F. A player will notify his/her coach prior to any absences from practice or a game. A continual attendance problem may be grounds for suspension from the team. The head coach will be directly involved in this decision.

G. Any WHL Lacrosse player who possesses, uses, transports, or is under the influence of any controlled substance, alcoholic beverage, intoxicant of any kind, or who possesses or sells any drug paraphernalia, shall be subject to suspension from the Lacrosse team.

Player and Parent Code of Ethics

Team sports are an integral part of a child’s overall development. All goals and objectives are established for the intellectual, physical, social and moral development of the players involved.

This is within this context that the following Code of Ethics is presented:

As a member of the SCS, I understand that it is my responsibility to:

1. Place academic achievement as the highest priority.

2. Show respect for teammates, opponents, officials and coaches.

3. Respect the integrity and judgment of the game officials and coaches, and refrain from “sideline” coaching and yelling of players and officials from the sidelines.

4. Exhibit fair play, sportsmanship and proper conduct on and off the playing field.

5. Maintain a high level of safety and awareness.

6. Refrain from the use of profanity, vulgarity and other offensive language and gestures.

7. Adhere to the established rules and standards of the game of Lacrosse.

8. Respect all equipment and use it safely and appropriately.

9. Refrain from the use of alcohol, tobacco, illegal and non-prescriptive drugs, anabolic steroids or any substance to increase physical development or performance that is not approved by the United State Food and Drug Administration, Surgeon General of the United State or American Medical Association.

10. Know and follow all athletic rules and regulations as they pertain to eligibility and sports participation.

11. Win with character, lose with dignity.

12. Emphasize the ideals of sportsmanship, ethical conduct, integrity, and fair play.
